Man accused of killing Giovanni’s owner refuses first court appearance

ALBUQUERQUE, N.M. — The man charged with taking the life of Rosario Zito, the beloved owner of Giovanni’s Pizzeria, was expected to make his first court appearance Thursday.
However, Sylvan Alcachupas refused to appear in court. His case was transferred to District Court and the state has filed a motion for pretrial detention, which would keep him behind bars until trial. That hearing is expected to happen within 10 days.
Alcachupas will remain in custody for now.
