New Mexico legal expert: New evidence may show Trump committed crime

ALBUQUERQUE, N.M. — A New Mexico legal expert said Thursday that a House committee hearing shows, for the first time, possible evidence that then-President Donald Trump may have committed a crime during and before the events of the insurrection at the U.S. Capitol on Jan. 6, 2021.

University of New Mexico law professor Joshua Kastenberg believes there’s a specific criminal charge the committee may be building evidence toward: seditious conspiracy.

He believes that evidence shows the former president was hindering Congress – a separate branch of the U.S. government.

“There has to be a meeting of the minds, a general shared intent, and it’s very clear that that’s where the House investigation is going, that there’s overwhelming proof – as they’re presenting it – of a shared intent precisely to cause what happened or worse, to overthrow the Congress,” Kastenberg said.

If that were to happen, it would be the first time a former president would face an indictment.

Kastenberg said it’s compelling the committee is saying the planning didn’t just come from the violent white supremacist group the Proud Boys – this evidence shows it may have come from the White House.
