Official Rules: Dog Days of Summer 2022
Please note: The Dog Days of Summer Contest ended at 12 noon (12:00:00 pm) MT on Friday, July 29, 2022. We inadvertently ran commercials promoting the contest after that deadline and apologize for any confusion this error may have caused.
1. HOW TO ENTER/PLAY
NO PURCHASE NECESSARY TO PARTICIPATE OR TO WIN. The Entry Period will begin at 12 midnight (12:00:00 am) Mountain Time (“MT”) on Thursday, June 30 , 2022 and end at 12 noon (12:00:00 pm) MT on Friday, July 29, 2022. There are two (2) separate categories for this contest: (1) Photographs and (2) Video. To enter, go to http://www.kob.com, complete the entry form and upload either a video or a photograph of your pet keeping cool or just having fun (collectively, a “Submission”). You may enter for both categories, but there is a limit of one Submission per category, and you cannot win both categories. Your photograph must be in a JPEG format (.jpg or .jpeg). Photos submitted by other means or formats will not be accepted. Your video can be uploaded in a .avi, .dv, .mov, .qt, .mp4, .mpeg, .3gp, .asf, .wmv, or .mpg file. Maximum file size = 200 MB. Video files and photographs submitted by other means will not be accepted. Each video and photo submission must be an authentic, original material and the contestant must own the copyright. Contestants certify that any individuals appearing with the pet other than themselves shown in the photo or video have been informed that the photo or video, and their image has been entered in the contest, have provided permission to use said image (or their parent/legal guardian has provided such permission) and have no objection to the submission and Sponsor’s display and posting of such photo for the purposes of the Contest. Sponsors reserve the right to disqualify or withdraw any entry that is alleged to infringe on any third-party’s intellectual property, publicity or privacy rights, or that Sponsor deems obscene, offensive or otherwise inappropriate for viewing by a general audience. Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible Submissions (or portions thereof), or for failure to receive Submissions due to transmission failures or technical failures of any kind, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. All entries become sole property of Sponsor and none will be acknowledged or returned. Contestants acknowledge and agree that Sponsor shall have the right to edit, adapt, modify, reproduce, publish, promote, broadcast, or otherwise display or use Submissions in any way it sees fit without limitation, permission, notification or compensation to entrants.
2. Judging/Winner Selection
Each qualifying Submission will be posted on KOB-TV’s website at http://www.kob.com from 12 midnight (12:00:00 am) Mountain Time (“MT”) on Thursday, June 30, 2022, through 12 noon (12:00:00 pm) MT on Friday, July 29, 2022, where the public can cast their vote for their favorite photographs in each category. The five (5) photographs and five (5) videos with the highest number of votes will then be deemed the Finalists. Thereafter, on or about Monday, August 1, 2022, each Finalist’s Submission will be judged by a panel of judges from KOB-TV, in their sole and absolute discretion, using the following judging criteria: (1) photo/video quality (49%) and (2) creativity (51%). The top scoring Finalist from each category will be deemed the winner for that category. In the event of a tie, the Finalist with the highest score in the creativity criteria from among all tying Finalists will be deemed the winner. The winners will be announced on KOB Eyewitness News 4 Today between 6:00 a.m. MT and 7:00 a.m. MT on Wednesday, August 3, 2022.
3. PRIZES
There will be two (2) winners in this contest; one for each category – video and photo. Each winner will receive a $250 Gift Card. A qualified winner must meet the eligibility requirements as set forth in Paragraph 4 of these rules. (Prize value: $250 each). Prize is subject to the manufacturer’s warranties.
In addition, a donation of $250 will be made in each winner’s name to non-profit Watermelon Mountain Ranch.
4. CLAIMING A PRIZE
The winners will be notified on or about Thursday, August 4, 2022 at the email address provided on the winner’s entry form or by phone at the number provided during entry. Winner must respond within 48 hours after notification. Failure to respond within such time period or return of email notification as undeliverable may result in disqualification and an alternate winner may be selected at Sponsor’s sole discretion. Each winner must claim his/her prize in person at the KOB 4 Studios, 4 Broadcast Plaza SW, Albuquerque, NM 87104, during normal business hours (Monday-Friday, 9:00 a.m. to 5:00 p.m.) within ten (10) business days after the day he or she wins. Failure to comply with this deadline shall be deemed to be the winner’s forfeiture of his or her right to claim a prize. Each winner must present identification acceptable to KOB 4 (e.g., state driver’s license; state issued identification card; valid passport with address verification; or birth certificate with social security card and photo identification and address verification). If a winner cannot prove he or she is qualified to accept the prize, the prize will not be awarded. All unclaimed prizes remain the property of KOB 4.
Acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of the Sponsors. Prizes are non-assignable and nontransferable. No substitutions allowed by winner. If a winner cannot prove to KOB-TV’s satisfaction that he or she is a qualified winner, the prize will not be awarded.
5. ELIGIBILITY
Individuals must be 18 years or older and legal U.S. residents of the State of New Mexico or within the KOB-TV broadcast area to be eligible to win. Employees of KOB-TV, LLC, Hubbard Broadcasting, Inc., or any of their subsidiaries, and their immediate families, or employees of Albuquerque area radio or television stations, or employees and immediate families of Fiesta Auto Group are not eligible to enter. Anyone participating in this contest or claiming a prize in this contest in violation of these rules will be disqualified from winning a prize in this contest and from participating in KOB-TV contests for a period of one year.
6. RELEASE: CONSENT TO USE LIKENESS, VOICE AND ADDRESS
The winners may be required to execute an affidavit of eligibility or liability / publicity release. The winners (a) agrees to release KOB-TV, LLC, Hubbard Broadcasting, Inc., (including their subsidiaries, affiliates, parent or related companies) from any and all liability, claims, damages and actions arising directly or indirectly out of or sustained in connection with the awarding or acceptance of the prize(s), and (b) consents to the use by KOB-TV for promotional purposes of his or her likeness, voice and/or address (city/state) without any additional compensation. By submitting a photo to participate in this contest, each participant acknowledges that he or she is aware, or may be presumed to be aware that his or her photo may be or likely will be broadcast on KOB 4 and posted on KOB-TV’s website. By participating in this contest, each participant agrees to the application of these official rules.
7. MISCELLANEOUS
Decisions of KOB-TV concerning any and all matters with respect to this contest shall be final. In the event there are not enough qualified Submissions for any category, Sponsor reserves the right to modify the number of Finalists there are for that category.
Contest void where prohibited or otherwise restricted by law. Prizes are not transferable or exchangeable. Prizes must be accepted in their entirety. KOB-TV reserves the right to change the prize values at any time or to substitute a prize for equal or greater value. If the sponsors determine in their sole discretion that the integrity or fairness of this contest has been corrupted in any manner, the sponsors reserve the right to terminate the contest and to select a winner from among entries legitimately received prior to termination.
KOB-TV is not responsible for printing errors in the contest materials or these rules.
KOB-TV is not responsible for delays attributable to web casting, technical or atmospheric conditions that disrupt the completion of the photo/video download, or any other computer problems which may or may not result from this contest.
