ALAMOGORDO, N.M. – The man accused of shooting and killing an Alamogordo police officer is set to come face-to-face with a judge Monday morning.
Police say Dominic De La O shot and killed Alamogordo police officer Anthony Ferguson. The deadly shooting happened two weeks ago during a shootout after officers tried to pull De La O over.
A judge is set to decide whether De La O will stay in jail until his trial. He is facing 10 charges, one of those first-degree murder. But, this isn’t the first time De La O has come face-to-face with police.
“It’s heartbreaking, and I’m very sorry that I’ve had to go through this two, or three different times in my career. Bad, bad time in Alamogordo,” said Otero County District Attorney Scot Key earlier in July.
De La O is accused of shooting and killing officer Ferguson. At the time of the shooting, officials say De La O had two other active criminal cases against him.
It started in January 2022, De La O was driving drunk and fled from law enforcement. Police arrested him but was released on bond with conditions – which he later violated.
In January 2023, officers tried to serve a warrant on De La O when a foot chase led to a shooting.
“A couple of police officers engaged him, with the intent – obviously – to arrest him on the warrant. He struggled. A gun was exhibited in a manner that precipitated the police officer shooting him,” said Key.
Prosecutors say De La O appeared to have a pattern of continuously violating his conditions of release which what kept him behind bars.
“And he was actually held without bond, pending trial,” Key said.
At the time, Judge Angie Schneider revoked his conditions of release. His attorney argued he wasn’t given the proper medical care in jail.
Schneider agreed to “give him one more chance.” But a month later, police say De La O shot and killed officer Ferguson.
De La O is set to be in front of a judge for his arraignment and pretrial detention.
