The officer was placed on the Brady-Giglio list which raises questions about the credibility and validity of their testimony.
ALBUQUERQUE, N.M. — The fallout from the federal investigation into a DWI scheme involving local law enforcement is leading to more DWI cases dismissed.
A spokesperson for the Bernalillo County District Attorney’s Office said they had to dismiss 22 DWI cases because of the credibility of the officer involved in those cases – Toby LaFave.
NMSP put Toby LaFave on leave last week over his suspected link to the investigation. LaFave is now on the Brady-Giglio list, meaning his testimony isn’t credible in court.
Since the scheme came to light last year, the district attorney’s office has had to dismiss around 250 DWI cases.
